NOTICE TO PRIVATE SECTOR EMPLOYEES

 

This Notice is provided in accordance with the decision of the United 5tates Supreme Court in Communication Workers of America v. Beck 487 R.S. 735(1988) and cases decided under the National Labor Relations Act. The purpose of this Notice is to advise all persons employed in the private sector within a bargaining unit exclusively represented by Indiana-Kentucky Organizing Committee 962 of the American Federation of State, County an Municipal Employees and its affiliates and under a collective bargaining agreement requiring the payment of dues as a condition of employment, of their legal right to either join the union or to become a "financial core" member. 

 

Financial core members are not members of the union and therefore are not afforded the many benefits associated with union membership. For example, financial core members may not attend union meetings, participate in the ratification of collective bargaining agreements or elect union officers. However, financial core members do receive the benefits of the union's representation as it relates to the terms and conditions of their employment. As such, the law provides that financial core members must pay a fee in an amount at least equal to the union's representational services. 

 

Individuals who elect not to join the union and to become a financial core payer have the right to: 1) object to paying for union activities not germane to the union’s duties as the bargaining representative (non-representational activities) and to obtain reduction in fees for such activities; 2) receive sufficient information to enable the individual to intelligently decide whether to object; and, 3) be apprised of any internal union procedures for filing objections. Objections must be in writing and include the objector’s name, address, social security number, job title, employer work location and local union affiliation, if known. Written objections must be postmarked no later than December 31, 2026 and addressed to the following:
